AuthSMTP - SMTP Diagnosic Program

This program can help diagnose your Internet connection for use with AuthSMTP. Some ISP's and firewalls block the default port (25) used by SMTP so it will attempt connections to our servers over various alternate SMTP ports.

This program is provided subject to the following agreement:

AGREEMENT

You should read this carefully - by accepting this agreement or using the software you agree to be bound by the Terms and Conditions set out below. If you do not agree to all of the Terms and Conditions set out below you must not use the software.

This software is copyright AuthSMTP / GetOnline Ltd 2008. All Rights Reserved. You may not use this software other than as expressly permitted, nor permit any other person to use this software in any way.

INDEMNIFICATION

You agree to indemnify and hold AuthSMTP / GetOnline Ltd. harmless from and against any claims, damages, losses, liability, costs and / or expenses arising from the use of this software.

WARRANTY

This software is provided 'as is' and 'as available' without warranty of any kind either express or implied including (but not limited to), warranties of merchantability or fitness for a particular purpose.

We do not warrant the software will be error free.

Any use of this software is at your own risk and you are responsible for ensuring that it is fit for your intended purpose.

LIMITATION OF LIABILITY

We do not seek to limit liability for death or personal injury resulting from our negligence or for fraud.

However, you acknowledge that this software is not appropriate for uses where personal injury or death could arise from use or reliance on the software and you should satisfy yourself as to the accuracy of any statements made by us or on our behalf.

You should not use this software for any "mission critical" purpose or any purpose whereby a failure of the software may result in loss or damage to any person.

You agree that we will not be held responsible for any economic loss, or any indirect or consequential loss or damage (whether loss or profit, loss of opportunity or otherwise), costs, expenses or claims for consequential loss whatsoever which arise out of or in connection with the supply of this software and its use or resale.

You further agree that, subject to the other provisions of these Terms and Conditions, our total liability arising in relation to the software or its use shall not exceed one thousand pounds.

STATUTORY RIGHTS

Nothing in this contract affects your statutory rights.

THIRD PARTY ISSUES

Unless the contract states otherwise in writing, the benefit of this contract is personal to you and only you can enforce the contractual terms.

SEVERABILITY AND CONFLICT OF TERMS

If a court decides that any part of these terms is void, voidable or unenforceable, the rest of these terms shall continue to be valid and enforceable. A court will, if possible, modify the offending term to the minimum extent necessary to make it valid.

If you are a business, our standard terms and conditions are to prevail over any you seek to impose.

FORCE MAJEURE

We are not liable to you for any failure to perform our obligations due to circumstances outside our control.

INTERPRETATION AND GOVERNING LAW

This is a plain English contract. Other than defined terms, words and expressions have their normal English meaning as they would be understood by a reasonable person in the context of this contract.

This contract is governed by the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the English courts.

The program only runs on Microsoft Windows and requires your Internet connection to be active / online before it is run. It is also being continually developed - this version will not work after 30-October-2008.
